Legal Notice Format – How to Send a Legal Notice in India

Quick answer: A legal notice is a formal letter, usually sent through an advocate, that sets out your grievance, the legal basis for it, what you want the other side to do, and the deadline – warning that you will take legal action if they don't comply. It should be on the advocate's letterhead, state the facts in numbered paragraphs, and be sent by registered post with acknowledgement or speed post, keeping the receipts as proof.

A well-drafted notice often settles a dispute without going to court. A badly drafted one can weaken your case later. Here is the format, step by step.

When do you need a legal notice?

In most disputes a legal notice is not compulsory – but it is good practice, because it gives the other side a chance to settle and shows the court you acted reasonably. In some cases, the law requires a notice before you go to court:

SituationNotice requirement
Cheque bounce (Section 138, Negotiable Instruments Act)Send a demand notice within 30 days of receiving the bank's return memo; the drawer then has 15 days to pay before you can file a complaint
Suit against the government or a public officer (Section 80, Code of Civil Procedure)Notice of two months before filing the suit, with limited exceptions
Ending a monthly tenancy (Section 106, Transfer of Property Act)Notice to quit as required by the Act or the agreement

Common non-mandatory uses include recovering money, unpaid salary or dues, consumer complaints, property and tenancy disputes, breach of contract, and defamation.

The legal notice format

A legal notice usually follows this structure:

  1. Letterhead – the advocate's name, enrolment number, office address and contact details.
  2. Mode of sending and date – e.g. "By Registered Post A.D. / Speed Post / Email".
  3. Recipient – the full name and correct address of the person or company (for a company, the registered office).
  4. Subject line – one line: "Legal notice for recovery of ₹2,50,000 due under invoice no. 104".
  5. Opening – "Under instructions from and on behalf of my client [name, address], I serve you with the following notice."
  6. Facts – in numbered paragraphs, in date order: the relationship, the agreement, what was promised, what went wrong. Refer to documents by date and number.
  7. Legal basis – the contract clause, law or section that gives your client the right to relief.
  8. Demand – exactly what the recipient must do: pay a specific amount, vacate, deliver, stop an act, apologise.
  9. Deadline – a clear time to comply, commonly 15 or 30 days (or the period fixed by law, as in cheque bounce cases).
  10. Consequences – that your client will start civil and/or criminal proceedings at the recipient's risk as to costs.
  11. Signature – of the advocate, with a note that a copy is kept for records.

Sample opening paragraph

"Under instructions from my client, Mr. Arjun Menon, residing at [address], I hereby serve upon you this legal notice. My client supplied goods to you under invoice no. 104 dated 2 June 2026 for ₹2,50,000, which you received without objection. Despite repeated reminders, you have failed to pay the said amount…"

How to send a legal notice

  • Registered post with acknowledgement due (RPAD) or speed post – the standard modes. Keep the postal receipt and the tracking report or acknowledgement card.
  • Email and WhatsApp – often used in addition to post. Courts have accepted electronic service in many situations, but post remains the safest primary mode.
  • Keep copies of the notice, the receipts and proof of delivery. You will need them if the matter goes to court.
  • If the recipient refuses delivery, the refusal is generally treated as valid service – keep the returned envelope unopened as proof.

Can you send a legal notice without a lawyer?

Yes – anyone can send a notice in their own name. But a notice from an advocate is usually taken more seriously, and an advocate drafts it so that it supports your case if you have to go to court: the right facts, the right legal basis, and nothing that could be used against you later.

What happens after you send it?

The recipient may:

  • Comply – pay, deliver or settle within the deadline.
  • Reply – deny the claim or offer a settlement. A reply is not compulsory, but ignoring a notice is usually unwise.
  • Ignore it – you can then take the next legal step, such as filing a civil suit, a consumer complaint or a cheque bounce complaint.

Common mistakes to avoid

  1. Vague facts – no dates, amounts or document references.
  2. Wrong name or address – the notice may not count as served.
  3. No clear demand or deadline.
  4. Missing a statutory deadline – for example the 30-day limit in cheque bounce cases.
  5. Abusive or exaggerated language – it can backfire and even invite a defamation claim.
  6. Admissions – wording that accidentally concedes a point the other side can use.

Frequently asked questions

Is a legal notice mandatory before filing a case?

Not always. It is legally required in some cases – such as cheque bounce complaints and suits against the government – and recommended in most others.

How many days does the other side get to reply?

The notice sets the deadline, commonly 15 or 30 days. In cheque bounce cases the law gives the drawer 15 days from receiving the notice to pay.

Can a legal notice be sent by email or WhatsApp?

Yes, often in addition to registered post or speed post. Post remains the safest primary mode because it gives clear proof of delivery.

What if the recipient refuses to accept the notice?

Refusal of a properly addressed registered letter is generally treated as valid service. Keep the returned envelope and tracking report as proof.

How much does a legal notice cost?

It depends on the matter and the advocate. Nevo Legal offers legal notices for a fixed professional fee – see the legal notice service page.
