Trademark Objection Reply Filing

What is a trademark objection?

After you file a trademark application, the Trade Marks Registry examines it and issues an examination report. If the examiner believes the mark should not be registered as filed, the status changes to “Objected”. You must file a reply within 30 days of receiving the report; otherwise the application may be treated as abandoned.

Common grounds for objection

  • Section 9 (absolute grounds): the mark is descriptive, lacks distinctiveness, is a common word in the trade, or could deceive the public.
  • Section 11 (relative grounds): the mark is identical or similar to an earlier registered or applied-for mark for similar goods or services.
  • Procedural issues: wrong class, vague description of goods/services, missing user affidavit or authorisation.

How we reply

  1. We study the examination report and the cited marks.
  2. We assess distinctiveness, differences from cited marks and evidence of your use.
  3. A lawyer drafts a reply supported by facts and relevant case law, and an affidavit with evidence where useful.
  4. We file the reply online and track the application.

If the examiner is not satisfied, a show-cause hearing is scheduled. We can represent you at the hearing for an additional fee.

Why a strong reply matters

Most objections can be overcome with a well-argued reply and the right evidence. A weak or late reply is the most common reason trademark applications fail. Haven’t filed yet? Start with trademark registration and a proper search.
